A片不受著作權保護 日片商提告不起訴

日本成人片片商石井猛因公司製作的2百多部影片未經授權,遭台灣1間科技公司上傳到旗下的色情網站,給網友付費下載, 因此片商認為著作權受到侵害,憤而跨海提告。

據了解,台灣的愛爾達科技公司先前將日本成人片片商石井猛的公司所製的成人影片上傳到旗下色情網站HI-5,讓網友付費下載,因此片商石井猛認為,他們製作的成人影片是花錢請導演、演員、化妝師、攝影師、燈光師等人員創作,應享有著作權,並主張愛爾達科技公司侵犯了他們的著作權,憤而控告。

檢方認為,成人影片中的男女以不同體位性交、口交等,還局部放大特寫,屬色情影片。另外,最高法院的實務見解,認為色情影片未在著作權的保障範圍,因此愛爾達科技公司無違法行為,獲不起訴。

North Korea threatens US' Japan military bases

SEOUL -- North Korea on Thursday threatened strikes on U.S. military bases in Japan and Guam, escalating tensions as suspicion deepened that Pyongyang was behind a cyber attack on South Korean broadcasters and banks.

The tone of the strike threat, attributed to a spokesman for the army's supreme command, blended with the torrent of warlike rhetoric from Pyongyang in recent weeks, but stood out for its precise naming of targets.

Military tensions on the Korean peninsula are at their highest since 2010, with Pyongyang irate at the use of nuclear-capable U.S. B-52 bombers and nuclear-powered submarines in joint military drills with South Korea.

“The U.S. should not forget that the Andersen base on Guam where B-52s take off and naval bases on the Japan mainland and Okinawa where nuclear-powered submarines are launched, are all within the range of our precision target assets,” the army spokesman said.

North Korea has successfully tested medium-range missiles that can reach Japan, but has no proven long-range missile capability that would allow it to hit targets on the U,S, mainland or Guam — more than 2,000 miles (3,200 kilometers) away.

Nevertheless, U,S, Defense Secretary Chuck Hagel announced last week that Washington had decided to bolster missile defenses along the U,S, West Coast so as to “stay ahead of the threat” from the North Korean regime.

North Korean leader Kim Jong Un had issued a more general threat to destroy U.S. bases “in the operational theatre of the Pacific” on Wednesday, as he directed a drone strike exercise.

Still photographs broadcast on state television seemed to show what looked like a rudimentary drone being flown into a mountainside target and exploding.

South Korea's Yonhap News Agency reported last year that the North was developing unmanned strike aircraft using old U.S. target drones imported from the Middle East.

Kim has personally overseen a host of rocket and artillery drills in recent weeks, mostly at frontline bases near the disputed maritime border with South Korea which has been a flashpoint for clashes in the past.

Since the U.N. Security Council tightened sanctions on North Korea over its nuclear test last month, Pyongyang has issued a range of apocalyptic threats including “pre-emptive” nuclear strikes.

It also announced it was scrapping the armistice that ended the 1950-53 Korean War, but its rhetoric has yet to be matched by any overt military action.

In Seoul, analysts said the latest threat to U.S. bases was another attention-grabbing move.

“This is just more bluster,” said Baek Seung-Joo, who heads the North Korea Research Team at the Korea Institute for Defense Analyses.

“It really seems aimed at shifting responsibility for the current tensions to the U.S. and South Korea conducting their joint military exercises,” Baek said.

The response from Tokyo was measured, with a foreign ministry official voicing regret at the North's “provocative action.”

In a further sign of current tensions, North Korea conducted a one-hour civil defense drill on Thursday morning, sounding a national air raid alert over state radio.

NICOSIA, Cyprus/FRANKFURT, Germany -- Cyprus has four days to agree on a new plan to raise funds to avoid bankruptcy, with the European Central Bank warning Thursday it will pull the plug on the country's banks at the start of next week if no solution is found.

Facing the ultimatum, the Cypriot government was racing to cement a new package that will please both Parliament and the country's potential international creditors.

Party leaders met with the president to consider a range of measures that could raise the 5.8 billion euros (US$7.5 billion) needed to qualify for 10 billion euros (US$12.9 billion) in rescue loans from the eurozone partners and the International Monetary Fund.

One measure agreed on Thursday was the creation of an “Investment Solidarity Fund” that would appeal for donations from ordinary Cypriots, businessmen and foreign investors, said Demetris Syllouris, head of a small right-wing party who was in the meeting with the president.

The legal and technical details were still being worked out, and the bill would be reviewed by the Cabinet Thursday evening, government spokesman Christos Stylianides said.

A “plan B” was being hashed out after lawmakers soundly defeated an earlier proposal to seize up to 10 percent of all domestic deposits to raise the 5.8 billion euros.

The rest of the “Plan B” will include restructuring Cyprus' troubled banks, some form of Russian help, dipping into pension funds and taking up an offer from Cyprus' wealthy Orthodox church to contribute. Some form of tax on bank deposits is also possible.

“We will have a program of support for Cyprus by Monday,” central bank governor Panicos Demetriades said as he left a meeting with the country's president and political party leaders.

Russia is likely to pitch in, though its contribution will be smaller than originally hoped for, Cypriot officials have said. Nearly a third of the 68 billion euros (US$88 billion) in deposits in Cyprus' oversized banking sector are held by Russians.

Cyprus' finance minister, Michalis Sarris, has been in Moscow since Tuesday seeking to forge a deal.

Russia's help would not be a loan, but rather some form of an investment, Sarris told Cypriot state broadcaster CyBC on Thursday. He is due to meet with his Russian counterpart, Anton Siluanov, and the Russian energy minister later in the day.

Russia news agency ITAR-Tass quoted him as saying that “we are discussing the subjects of gas, bank cooperation and other subjects.” Cyprus has recently discovered significant off-shore gas deposits, and major energy companies have shown an interest in tapping those resources.
